to the field tonight. i guess that means we can yell at the experts now. christie smith is live in oakland where some of the teams are not celebrating their return. christie, good morning. >> reporter: good morning to you, jon. we're finally able to catch up with some raiders fans and niners fans out here. this is coming down like breaking news on their texts and bluetooth. they're really happy about this. in fact it's the best news they're hearing in a long time. that the real refs expected to be out there on the field starting tonight. that according to the terms of an eight-year collective p bargaining agreement reached between the nfl and the referees association. it still needs a vote but after the game on monday night, the replacement refs were certainly in the cross-hairs with a lot of people. the raiders defensive back michael huff jokingly remarked that he liked the replacement refs. the team has certainly had its share of penalties but with the replacement. >> referee: they're averaging 4.7 penalties and 33 yards in four games. they say no one wants to be on the receiving end of

screaming in agony watching replacement refs for weeks. not really looking very good. christie smith is live in oakland and she has all the welcome details. christie, good morning. >> reporter: good morning to you, jon. you know we're out here by a coffee shop in oakland. i have to tell you this is coming out by break news. people getting it by text, hearing on their cell phone and it's about time, those are the words that we keep hearing over and over again from niners fans and raiders fans recalling that green bay game, saying they certainly don't want that kind of call to happen to their beloved teams here in the bay area, so they are very excited that the regular nfl refs are expected back on the field, as you said, tonight for a game. after refs -- or nfl and the refs union announced that a tentative agreement had been reached to end that lockout, the replacement refs, sparked a twitter frenzy outrage putting it mildly after a missed call on the last play at seattle monday that cost the packers the game. the tentative deal is eight years. still needs to be ratified, though. that's expec

. christie smith is live at albany where a memorial grew overnight for james izumizaki. a loft emotions flying out there, christie. good morning. >> reporter: good morning to you, jon. yeah, this is a tragic end to just a terrible situation. i spoke with one dad off camera. he said that his daughter is a student here and has been home crying since she heard the news. there are flowers as candles and notes in front of albany middle school this morning. most of the notes seem to be from student athletes, saying they love and miss their coach. the alameda county sheriff says a family member found james izumizaki dead in his car yesterday in san lorenzo. he was just 28 years old. his death being investigated as a suicide. he was a sixth grade teacher here and a volleyball coach, a basketball coach, very popular. students say he always went the extra mile for them. but last week he was arrested, accused of having an inappropriate relationship with a former student. the school will inform the student body today of his death but word is already spreading out there, especially on social media.

bay school district suspends its students. christie smith is live in oakland where the oakland unified school district will change its zero tolerance policy when it comes to african-american students. christie, good morning. >> reporter: good morning to you, jon. that's right, big changes on the way. the department of education launched an investigation in may into oakland public schools discipline policies and suspension rate and found that the zero tolerance approach to discipline may be violating some students' civil rights here in oakland of the some of the numbers are quite startling when you look at the suspension rates, considering that oakland public schools have about 32% of their students are black but they make up about 63% of all the students that are suspended and sent home. now, the office of civil rights looked into whether black students may be treated more harshly than white students when it comes to discipline. the action plan includes a number of changes over the next five years. the district will move toward restorative discipline instead of their zero tolerance pol

is praising lawmakers and the governor for creating tougher restricts for party buses. we have christie smith who spoke with the family about the reaction to the new law. >> reporter: good morning, laura. doug and linda studebaker wrapped up the press conference. their 19-year-old son was killed after partying on a party bus. today, they are celebrating preside the fact that governor jerry brown signed the bill into law. it is called the brett studebaker law. he was three times the legal limit in 2010. the bill now requires that party bus operators ask the person making the reservation if alcohol will be served and if anyone is under 21. they also have to check identification. none of this was required on the night that brett went out to celebrate a friend's birthday. >> i feel happy that something good can come out of something so bad. >> i think it's nicely put. we feel brett's presence quite a bit. we know that brett is smiling down on this day. >> reporter: now they spoke at the family home near the tree house that brett helped his father build. the law allows penalties against the chaper

of giselle esteban. she is accused of killing michelle le. we have christie smith live at the courthouse with the latest on the trial of giselle esteban. >> reporter: the prosecutor opened with a photo of a smiling michelle le. he showed another photo of what is believed to be her last photo. her walking out of a parking lot and near where she was working. this right before she disappeared. her family packed the courtroom. they did not speak, but wore buttons of the 26-year-old on them. le disappeared in may of 2011 where she was studying nursing. her body found four months later. a former friend of hers, esteban killed her because she had feeling for her boyfriend. i guess we're having problems with that awed oudio. later, he developed a serious relationship with esteban. later, they had a daughter together. he said giselle ruined their relationship. prosecutors said nothing was going on. the defense is up next. opening statements could last all day. the trial is expected to last about a month. reporting live in oakland, christie smith, nbc bay area news. >>> he is expected to be in cou
